Committee of Adjustment - Draft By-law and Hearing Proceedings

The Committee of Adjustment is appointed by City Council and delegated the authority to consider and make decisions on minor variance and consent applications in accordance the Planning Act.

Planning Staff have prepared a proposed Committee of Adjustment By-law and Hearing Proceedings to govern the appointment, mandate and duties of this Committee. The proposed By-law and Hearing Proceedings are provided below and would replace By-law 139 of 1991 of the City of Sarnia-Clearwater. The By-law would include updates that reflect current Planning Act terminologies and the legislative and regulatory responsibilities of a Committee of Adjustment under the Act.  In addition, the proposed by-law would include a Council appeal mechanism and clear hearing procedural rules to ensure accountability and transparency when the Committee holds meetings and makes decisions.
